Wireless testimony practice

Wireless Technology Expert Witness for ITC 337 and Federal Patent Matters

Party-retained testimony on cellular (LTE, 5G NR, NB-IoT), Wi-Fi (802.11ax, 802.11be), Bluetooth LE, 802.15.4 and Thread and Matter protocols for federal patent, ITC 337 and trade-secret matters.

The engagement

A wireless opinion grounded in the specification and the capture

Cellular and wireless matters have their own technical language. Standard Essential Patent portfolios read on specific sections of 3GPP releases; 802.11ax and 802.11be read on specific IEEE amendments; Matter reads on the Connectivity Standards Alliance specification and its underlying transport protocols. A useful expert opinion is grounded in the actual specification text and, where the record supports it, in packet captures or protocol logs that show the accused behavior on the wire.

For federal patent litigation and ITC 337 proceedings, the examination reviews the asserted patents against the accused specification sections, the accused product's protocol logs where the record supports it, and independent testing results where testing is proportional to the matter.

Subject matter coverage includes 3GPP LTE Release 8 through 5G NR Release 18, IEEE 802.11a/b/g/n/ac/ax/be, Bluetooth Classic and Bluetooth Low Energy, 802.15.4 and Thread, Matter, Zigbee and LoRaWAN. Coverage across the network, the device, the modem firmware and the application-layer software that sits above the wireless stack.

Scope

  • Cellular SEP infringement and essentiality

Element-by-element analysis of asserted claims against 3GPP TS documents. Essentiality analysis distinguishing mandatory specification requirements from optional or informative sections. Coverage of LTE Release 8 through 5G NR Release 18.

  • Wi-Fi and 802.11 patent testimony

Analysis of accused products against IEEE 802.11 amendments (802.11n, 802.11ac, 802.11ax and 802.11be) with attention to features such as OFDMA, MU-MIMO, TWT, MLO and 320 MHz channels where the matter turns on those elements.

  • Bluetooth, 802.15.4 and Matter

Analysis of Bluetooth LE, Bluetooth Mesh, 802.15.4 and Thread, Matter and Zigbee patent claims. Coverage of low-power protocols, mesh routing, discovery and pairing.

  • Modem firmware and IP allocation

Analysis of licensed modem chipsets in accused products and technical allocation of observed behavior between the modem implementation and the OEM's application-layer software. Counsel addresses patent exhaustion and recovery theories.

  • ITC 337 wireless proceedings

Wireless-technology expert work on ITC 337 schedules, including infringement, domestic-industry technical prong, redesigns and design-arounds. Coordinated expert coverage across parallel federal district-court matters.

  • Trade secret and technical breach in wireless product lines

DTSA and state trade-secret analysis for wireless product lines: firmware, calibration data, RF test procedures, reference designs and antenna designs. Coverage of common carve-out and residual-clause disputes.

  • Rebuttal, cross-examination and Daubert support

Rebuttal declarations on opposing wireless expert reports, cross-examination question sets for RF engineers and modem-firmware witnesses, and Daubert motion declarations on wireless expert methodology.

Methodology

How the wireless expert engagement runs

  1. Retention and scope

Retention letter, wireless-vendor and licensor conflict check and a scope note stating the wireless subject matter, releases and standards in scope.

  2. Specification and capture reconciliation

Reconciliation of asserted claims against the accused specification sections and, where the record supports it, against accused-product protocol captures.

  3. Report drafting

A written expert report anchoring every opinion to a specific claim element, a specific specification section and a specific piece of accused-product evidence.

  4. Deposition, hearing and trial testimony

Preparation, deposition, ITC hearing or district-court trial testimony bounded by the report and post-testimony workpaper retention.

Evidence commonly examined

Evidence reviewed

  • Asserted patents, file histories and prior-art references
  • 3GPP TS documents and IEEE 802 amendments for the accused releases
  • Accused product firmware, over-the-air update packages and application binaries where produced
  • Packet captures, protocol traces and modem debug logs where the record supports it
  • Vendor confidential specifications produced under the protective order
  • Opposing wireless expert reports, workpapers and testing records
  • Court orders, protective orders and ITC procedural schedules

What you can expect

What you receive

  • Expert report with per-claim-element analysis against 3GPP or IEEE specifications
  • Essentiality declaration where SEP essentiality is at issue
  • Testing appendix stating equipment, method and captured artifacts
  • Deposition and trial testimony bounded by the report
  • Rebuttal declaration on opposing wireless expert reports
  • Demonstratives sourced to specification sections and captured protocol traces

Frequently asked

Common questions

Do you take ITC 337 wireless work, or only district-court patent work?

Both. ITC 337 wireless proceedings are a routine assignment. Acceptance still depends on qualifications, conflicts, access and schedule, and the retention states the deliverables the procedural schedule permits.

Can you testify on SEP essentiality independent of infringement?

Yes. Essentiality declarations are handled as a distinct deliverable. Essentiality analysis stays inside the specification text; it does not import district-court claim constructions where those are not before the panel.

How is a packet capture used at hearing?

Where a capture is in the record, it becomes evidence like any other exhibit. The report cites the frame numbers relevant to the finding, and demonstratives show the specific fields on which the opinion turns.

Do you handle 5G NR matters where the accused release is still evolving?

The report anchors to the specific 3GPP release implemented by the relevant product version during the period at issue. Later releases are treated as background context, not as the basis for the finding.

Can you handle Matter or Thread patent matters?

Matter, Thread, Zigbee and Bluetooth LE can be within scope. Matter analysis follows the applicable CSA specification and the transport actually used, including Thread over 802.15.4, Wi-Fi or Ethernet as relevant.
